Terms and Conditions

How BudStack sells its software: what you get, how we invoice and take payment, how the service is delivered, and how cancellation and refunds work.

Last updated 12 October 2026

1. Who we are

BudStack is a trading name of Soft Development Solutions (Pty) Ltd, registration number 2023/165773/07(“BudStack”, “we”, “us”), 57 Camborne Road, New Redruth, Alberton, Gauteng, 1449, South Africa. We build and run software for cannabis retail stores: an online storefront, point of sale, delivery, loyalty, stock control and vendor consignment tracking.

2. What these terms cover

We sell to businesses, not to the public. We do not sell goods through this website, and you cannot buy a subscription by checking out here: every client signs a written Service Agreement with us first.

These terms apply to our services and to payments made to BudStack, including payments made online through PayFast. If your signed Service Agreement says something different from these terms, your Service Agreement applies.

3. Our services

Depending on what you sign up for, a BudStack subscription includes:

  • A licence to use the BudStack platform for your own stores, under your own brand.
  • A dedicated server environment and database for your business, which we host and maintain.
  • Your storefront and app on a BudStack web address, or on your own domain if you point it to us.
  • Updates and improvements to the platform, and support for using it.
  • Optional extras quoted separately, such as email marketing above the free allowance, additional server capacity and custom development.

4. Prices

Pricing depends on how many stores you run and what you need, so we quote each business individually. The fees, the term of the contract and any extras are set out in your quotation and Service Agreement. All prices are in South African Rand (ZAR). Where VAT applies, it is shown separately on the invoice.

We will give you at least 30 days' written notice before a price change takes effect, unless your Service Agreement fixes the price for a period.

5. Invoices and payment

  • Subscriptions are billed monthly in advance, unless you have agreed to pay for a longer period up front. Each invoice is emailed to your billing contact and shows the amount, what it is for and the date it is due.
  • You can pay by EFT into the bank account on the invoice, or online by card or instant EFT through PayFast using the “Pay now” link on the invoice.
  • Card payments are processed by PayFast on its secure payment pages. BudStack never sees or stores your card number.
  • Please use the invoice number as the payment reference, so we can match your payment to the right invoice.
  • Setup work, additional development and other once-off items are invoiced as quoted, before or when the work is done.

6. Delivery policy

BudStack is software provided online. Nothing physical is shipped and there are no delivery charges.

  • When it is delivered: once your Service Agreement is signed and your first invoice is paid, we set up your dedicated environment and email the login details to the contact named in your agreement, usually within two business days. That email is delivery of the service.
  • Your own domain: if you want the store on your own web address, it goes live once you have added the DNS record we send you at your domain provider. That step is in your hands, and we confirm by email when the address is live.
  • Ongoing: the service stays available for as long as your subscription is active and paid, subject to the uptime commitment and exclusions in your Service Agreement.
  • Custom work: delivered on the dates agreed in its quotation.

If you have not received your login details within the time above, email hello@budstack.co.za and we will sort it out the same business day.

7. Cancellation policy

  • Fixed term first. Most Service Agreements start with a minimum term (for example six months). The subscription cannot be cancelled for convenience during that term, or during any 12- or 24-month term you have chosen, unless we both agree in writing.
  • After that, month to month. You can cancel at any time by giving us 30 days' written notice by email to hello@budstack.co.za, unless your Service Agreement gives a different notice period. The service and billing continue until the notice period ends.
  • Your data on the way out. Before your access ends you can export your reports and records, and we will help with any data export agreed in your Service Agreement.
  • Cancelling custom work. If you cancel quoted development before it is finished, you pay for the work done up to the date you cancel.
  • If we end the agreementwithout you being at fault, we give you at least 30 days' notice and refund any fees you have paid for the period after the service ends.

8. Refund policy

Because the service is available to you from the start of each billing period, subscription fees for a period that has started are not refundable. We do refund money in these cases:

  • Duplicate payments and overpayments: refunded in full, or credited to your next invoice if you prefer.
  • Billing errors: if we invoiced the wrong amount, we issue a credit note and refund the difference.
  • Service we cannot provide: if we end the agreement without you being at fault, or cannot provide the service for reasons within our control, we refund fees paid for the period after the service stopped.
  • Fees paid in advance for a longer term are refunded on the same basis as above. They are not refundable simply because you stop using the service during a term you committed to.

How to ask for a refund: email hello@budstack.co.za with the invoice number and the reason. We reply within two business days. Approved refunds are paid within 10 business days, back to the card or account the payment came from: card payments through PayFast are refunded to the same card, and EFT payments to the bank account you give us.

If you think a payment is wrong, please contact us before disputing it with your bank, so we can put it right quickly.

9. Late payment and suspension

If an invoice is not paid by its due date we will remind you. If it stays unpaid after a reminder, we may suspend access to the platform until it is paid, as allowed by your Service Agreement. Your data is kept safe while access is suspended, and access is restored once the account is up to date.

10. Your data

Your business's operational data belongs to you. We process it only to provide, maintain and secure the service. How we handle personal information is set out in our Privacy Policy.

11. Liability

The limits of our liability, our uptime commitment and the ownership of the platform are set out in your Service Agreement. To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profit or revenue. Nothing in these terms limits rights you have under the Consumer Protection Act or the Electronic Communications and Transactions Act that the law does not allow to be limited.

12. Using this website

The information on this website is general and may change. Prices, features and plans are confirmed only in a written quotation or Service Agreement. The BudStack name, logo, software and website content belong to us and may not be copied without permission.

13. Law and disputes

These terms are governed by the law of the Republic of South Africa. If something goes wrong, please contact us first. We will try to resolve it with you directly. If we cannot, either of us may refer the matter to the appropriate South African court.

14. Changes to these terms

We may update these terms from time to time and will change the “last updated” date at the top. Changes do not alter a Service Agreement you have already signed. Where a change affects existing clients, we will tell them directly.
